DeAR OPS Terms of Service

These Terms of Service ("Terms") govern access to and use of DeAR OPs (De Animal Recovery Operations), a recovery management application provided by DeMASTER DRONES ("we," "us," or "our").
By accessing or using DeAR OPs, you agree to these Terms.
1. Description of Service
DeAR OPs is a software application designed to assist recovery operators with administrative and operational management.
Features may include:
Recovery request intake and record management.
Integration with Google Forms and Google Sheets.
Search scheduling and pilot assignments.
Hunter contact information and navigation tools.
Staff coordination and compensation tracking.
Search activity, results, and recovery documentation.
Operational summaries and search history.
Offline access and synchronization.
Features may change as the application develops.
2. Eligibility and Authorized Use
You must be legally capable of entering into a binding agreement to use DeAR OPs.
If you use the application on behalf of a business or organization, you represent that you have authority to accept these Terms on its behalf.
You are responsible for ensuring that individuals who access your operation's records are appropriately authorized.
3. Google Account and Data Connections
DeAR OPs uses Google services to support core application functions.
You are responsible for:
Maintaining a valid Google account with appropriate access permissions.
Selecting and managing the correct Google Sheet and Form.
Maintaining appropriate Google account and document-sharing permissions.
Ensuring the accuracy and legality of information entered or collected.
Keeping suitable backups of important business records.
Google services are provided independently by Google and are subject to Google's applicable terms and policies.
We are not responsible for outages, access restrictions, account suspensions, or service changes made by Google.
4. Your Data
You retain ownership of the business and recovery information you enter into or maintain through your connected Google account, subject to any rights held by the original information providers.
Using DeAR OPS does not transfer ownership of your recovery records to DeMASTER DRONES.
You grant us only the permissions reasonably necessary to operate and support the application as described in the Privacy Policy.
You are responsible for obtaining any required permissions, notices, or consents when collecting hunter information, photographs, location details, waiver acknowledgments, and other personal information.
5. Licenses and Access
DeAR OPs may be offered through paid seasonal or annual business licenses.
A license permits authorized use of the application for the applicable license period, subject to the purchased plan and these Terms.
Unless expressly stated otherwise, a license does not transfer ownership of the software or its underlying intellectual property.
License pricing, duration, renewal arrangements, and any included features will be disclosed at the time of purchase.
Expiration of a license may limit continued access to licensed application functionality. Expiration does not transfer ownership of an operator's Google Sheet or the records stored in it.
6. Payments, Renewals, and Refunds
If paid access is offered, applicable prices, payment terms, renewal arrangements, and refund conditions will be presented before purchase.
No automatic renewal will be imposed unless it is clearly disclosed and authorized during the purchase process.
Applicable taxes may be added where required.
Payment processing may be provided by an independent third-party payment service.
7. Offline Functionality
DeAR OPs may allow users to view cached information and make certain changes without an internet connection.
Offline functionality depends on the device, available cached information, and application conditions.
Changes made offline may require a successful reconnection before they appear in the connected Google Sheet.
Users are responsible for confirming that important changes have synchronized successfully before relying on those changes across multiple devices.
We cannot guarantee uninterrupted offline availability or conflict-free synchronization.
8. Operational Responsibility
DeAR OPs is an administrative and record-management tool. It does not perform or supervise physical recovery operations.
You remain solely responsible for your field activities, including:
Compliance with applicable hunting, wildlife recovery, aviation, and drone regulations.
Obtaining necessary licenses, authorizations, and property access permissions.
Making decisions about flight conditions and operational safety.
Ensuring staff members are appropriately qualified.
Verifying hunter-provided information and recovery locations.
Determining whether a search or recovery operation may lawfully proceed.
DeAR OPs does not provide legal, aviation, wildlife management, or safety certification advice.
9. Records, Waivers, and Payment Tracking
DeAR OPs may provide features for recording waiver acknowledgments, search activity, payments, and other operational information.
These features are provided for recordkeeping convenience.
We do not guarantee that a particular waiver, acknowledgment, record, or electronic entry satisfies every legal or regulatory requirement.
You are responsible for reviewing your own waiver language, business policies, and recordkeeping obligations.
10. Acceptable Use
You agree not to:
Use DeAR OPs for unlawful activities.
Access another operator's information without authorization.
Attempt to bypass licensing, authentication, or security controls.
Interfere with application functionality or other users.
Introduce malicious software or attempt unauthorized access to connected systems.
Copy, redistribute, resell, or reverse engineer the software except where expressly permitted by applicable law or written agreement.
11. Software Ownership
DeAR OPs, including its software, interface, design, branding, and associated intellectual property, belongs to DeMASTER DRONES or its applicable licensors.
Your license grants a limited right to use the application and does not grant ownership of the software.
Your own recovery records and business information remain yours.
12. Availability and Updates
We may release updates, correct errors, modify features, or perform maintenance.
We aim to provide a reliable service but do not guarantee that DeAR OPs will always be available, error-free, or compatible with every device or third-party service.
We may discontinue or modify features when reasonably necessary for security, compliance, maintenance, or product development, subject to applicable law and any commitments made in a purchased plan.
13. Disclaimer of Warranties
To the extent permitted by applicable law, DeAR OPs is provided on an "as available" and "as is" basis without warranties not expressly provided in a separate written agreement.
We do not warrant that use of the application will produce any particular recovery result, business outcome, regulatory compliance determination, or uninterrupted service.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
14. Limitation of Liability
To the extent permitted by applicable law, DeMASTER DRONES is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of DeAR OPs, including lost profits, business interruption, or lost records.
Our aggregate liability for claims arising from the service will not exceed the amount paid for the applicable DeAR OPs license during the twelve months preceding the event giving rise to the claim, except where such a limitation is prohibited by law.
These limitations do not exclude liability that cannot legally be limited.
15. Suspension and Termination
We may suspend or terminate application access for material violations of these Terms, unauthorized use, security threats, or nonpayment, subject to applicable law.
You may discontinue use of DeAR OPs at any time.
Discontinuing use does not automatically delete records maintained in your own Google account.
16. Changes to These Terms
We may update these Terms to reflect changes in the application, business practices, or legal requirements.
Material changes will be communicated as appropriate. Where required, continued use will be subject to acceptance of updated Terms.
17. Governing Law
These Terms are governed by the laws of the State of Wisconsin, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.
